Abstract

الملخـــص :

نتكلم من خلال هذه المذكرة، عن الشروط الاستثنائية كمعيار مميز للعقود الإدارية، حيث نبين الشروط الاستثنائية المقررة للإدارة العامة في مواجهة المتعاقد معها، وكذا الشروط الاستثنائية المتعلقة بالامتيازات الممنوحة للمتعاقد مع الإدارة في مواجهة الغير، بالإضافة إلى شرطين استثنائيين، الإحالة إلى دفتر الشروط ، وجعل الاختصاص للقضاء الاداري .

Résume : En Parler à travers cette mémoire, au conditions exceptionnelles comme la norme le caractère standard de contrats administrative et, le cas preuve d'un caractère exceptionnel conditions prévues à l'administration publique dans le visage contracté, ainsi que les conditions exceptionnelles accordées a l’entrepreneur dans la visage des personnes, en plus de l'exigence de deux exceptionnelles, a l’affectation au cahiers des charges, et de faire de la compétence pour la justice administratifs .
