Abstract

ملخّــص: يعتبر الإشهار التجاري أحد أهم مكونات المزيج التسويقي،وضرورة من ضروريات الحياة العصرية ،لما له من فوائد جمة على المستهلك والعون الاقتصادي، لذلك فهو مظهر من مظاهر المنافسة المشروعة. ولكن بالرغم من ذلك يمكن أن يتحول إلى وسيلة إضرار بالمستهلك إذا كان كاذبا أو مضللا ،مما استدعى تدخل المشرع إلى ضبط هذا النشاط من خلال تكريسه آليات قانونية وقائية وردعية توفر الحماية الفعالة للمستهلك. غير أنه يبقى أمرا غير كاف في غياب الوعي لدى المستهلك وكذا عدم وجود قانون خاص ينظم الإشهار التجاري

Résumé: La publicité commerciale est l’un des éléments les plus importants du marketing-mix et de la nécessité des nécessités de la vie moderne, en raison de ses grands avantages pour le consommateur et de son aide économique; elle est donc une manifestation de la concurrence légitime. Cependant, il peut également devenir un moyen de préjudice pour le consommateur s'il est faux ou trompeur, ce qui oblige le législateur à intervenir pour contrôler cette activité en mettant en place des mécanismes juridiques préventifs et dissuasifs offrant une protection efficace au consommateur. Cependant, il reste insuffisant en l'absence de sensibilisation des consommateurs et en l'absence d'une loi spéciale réglementant la publicité commerciale.

Abstract : Commercial advertising is one of the most important components of the marketing mix, and the necessity of the necessities of modern life, because of its great benefits to the consumer and economic aid, so it is a manifestation of legitimate competition. However, it can also become a means of harm to the consumer if it is false or misleading, which requires the legislator to intervene to control this activity through the establishment of preventive and deterrent legal mechanisms that provide effective protection to the consumer.
