النظام القانوني للمحاكم التجارية المتخصصة في الجزائر

Abstract

ملخص: نتيجة لانفتاح السوق الاقتصادي و التجاري و في إطار مشروع اصلاح العدالة من أجل موكبه التطورات الاقتصادية و التجارية الدولية في عالم المال و الاستثمار أصدر المشرع الجزائري قانون 22 -13 و الذي استحدث بموجبه محاكم تجارية متخصصة لتنظر في منازعات تجارية برئاسة قاضي و مساعدين ممن لهم دراية بالمسائل التجارية. كما جعل المشرع الصلح قيد على رفع الدعوى أمام هده المحاكم من اجل الوصول لحل ودي بين الخصوم، إما إذا لم يتم الصلح بين الخصوم ترفع الدعوي أمام المحاكم التجارية المتخصصة لتفصل فيها بحم قابل للطعن بالطرق العادية و الغير العادية وفقا للقواعد العامة.. Résume : En raison de l'ouverture du marché économique et commercial et dans le cadre du projet de réforme de la justice pour accompagner les évolutions économiques et commerciales internationales dans le monde de la finance et de l'investissement, le législateur algérien a émis la loi 22-13, établissant ainsi des tribunaux commerciaux spécialisés chargés de statuer sur les litiges commerciaux sous la présidence d'un juge et de ses assistants ayant une connaissance des questions commerciales. De plus, le législateur a rendu la médiation obligatoire avant de saisir ces tribunaux afin de parvenir à un règlement amiable entre les parties en litige. En cas d'échec de la médiation, le litige est porté devant les tribunaux commerciaux spécialisés pour statuer dessus, avec possibilité de recours selon les voies de recours ordinaires et extraordinaires conformément aux règles générales Abstract: Due to the opening of the economic and commercial market and as part of the justice reform project to keep pace with international economic and commercial developments in the world of finance and investment, the Algerian legislator issued Law 22-13, thereby establishing specialized commercial courts to adjudicate commercial disputes under the presidency of a judge and assistants who are knowledgeable about commercial matters. Furthermore, the legislator made mediation a prerequisite for filing a claim before these courts in order to reach an amicable solution between the parties. If mediation fails, the dispute is referred to the specialized commercial courts for adjudication, with the possibility of appeal through ordinary and extraordinary means according to general rules.
