ضمانات الاستثمار في القانون 22-18

Abstract

الملخص: كرس المشرع الجزائري من خلال القانون رقم 22-18 جملة من الامتيازات والضمانات والتي تعمل على تشجيع وجذب الاستثمار، كما تضمن تسهيلات مالية وقانونية تهدف إلى إزالة وتخفيف القيود والأعباء المالية والإجرائية، وكذا إزالة التعقيدات البيروقراطية على مستوى الجهات الإدارية بإنشاء أجهزة وهيئات لتأطير عملية الاستثمار مع إعطاء للمستثمر سواء الوطني أو الأجنبي حق اللجوء إلى القضاء الوطني والتحكيم التجاري الدولي لحل منازعات الاستثمار.

Résumé: Le législateur algérien, à travers la loi n° 22-18, a consacré un certain nombre de privilèges et de garanties qui visent à encourager et attirer les investissements. Elle comprend également des facilités financières et juridiques visant à supprimer et à alléger les restrictions et charges financières et procédurales, ainsi qu'à supprimer. des complications bureaucratiques au niveau des autorités administratives en créant des agences et des organismes pour encadrer le processus d'investissement en donnant à l'investisseur, qu'il soit national ou étranger, le droit de recourir au système judiciaire national et à l'arbitrage commercial international pour résoudre les différends en matière d'investissement.

Summary: The Algerian legislator, through Law No. 22-18, enshrined a number of privileges and guarantees that work to encourage and attract investment.
