الحصانة البرلمانية وكيفيات زوالها في النظام الدستوري الجزائري

Abstract

الملخص : تعتبر الحصانة البرلمانية إمتيازا يحمي عضو البرلمان من أي تهديد يواجهه أثناء ممارسة مهامه النيابية، وهي نوعان حصانة موضوعية تشمل الآراء و الأفكار التي يبديها العضو أثناء تأدية مهامه النيابية، وحصانة إجرائية تتعلق بالإجراءات الجزائية المتخذة ضد العضو. وقد تزول و تنتهي هاته الحصانة إما بطرق عادية كحل المجلس أو انتهاء مدته، أو بطرق غير عادية كحالة تلبس عضو البرلمان بالجريمة التي ينتج عنها مجموعة من الإجراءات القانونية لرفع الحصانة البرلمانية.

Résumé : L’immunité parlementaire est considérée comme un privilège qui protège un député pendant qu’il exerce ses fonctions, de toutes menaces a lab quelle il est confronté. L’immunité parlementaire peut-être fini d’une façon normale ou d’une façon anormale, en cas de flagrant délit en comment un crime, et ici ça s’engage des procédures judicaires.

Summary: Parlementary immunity is considered a privilege that protects a member of any threat he faces in the performance of his representative duties parliament.
