Abstract

ملخص: جنوح الأحداث من الظواهر التي شغلت بال الباحثين في عدة مجالات ،نظرا لكونها ظاهرة تمس فئة عمرية جد حساسة في المجتمع و هي فئة الأحداث.ولكي يتم التعامل مع هذه الظاهرة و مواجهتها قام المشرع الجزائري بتخصيص قانون لحماية الطفل و هيئة للتعامل مع هذه الفئة العمرية بتحديد مسؤوليتهم الجزائية و بإنشاء هيئة قضائية مختصة تباشر القواعد الإجرائية المطبقة على الجانحين في جميع مراحل الدعوى الجنائية،و إقامته على مبادئ و مفاهيم مختلفة عن القواعد العامة في كثير من الأحيان تبين أسس المعاملة الجنائية للطفل و تحدد معلمها. Résume : La délinquance des mineurs est un phénomène qui a pris l’attention des chercheurs dans plusieurs domaines car ce phénomène touche une catégorie d’âge très sensible dans la société c’est la catégorie mineurs. Le législateur algérien a légiféré une loi sur la protection de l’enfance, pour traite ce phénomène. Il détermine la responsabilité pénale et prévoit l’établissement d’une institution judiciaire, compètent pour exerces les règles procédurales applicables aux mineurs, dans toutes les étapes de l’action publique.et elle clarifie les fondements du traitement pénal de l’enfant et définit ses contours. Resume: The juvenile delinquency is one of the phenomena that preoccupied researchers in many domains .because it affecting a very sensitive age group in the society are the juvenile. To deal with these phenomena, the Algerian legislation has made a law to protect this part of society which determines their penal responsibility and plans the establishment of a competent judicial, institution to exercise the procedural rules applicable to the minors, in all the stages of the public. And she clarifies the foundations of the penal treatment of the child and defines its landmark.
