النظام القانوني للدواء الجنيس في التشريع الجزائري

Abstract

الملخص: يعد الدواء الجنيس منتوج صيدلاني له أهمية كبيرة تقوم عليها الصحة العامة، وهو ركيزة من ركائز الإقتصاد الصحي بالنسبة للدول التي لا تملك نظام بحث يقوم على أسس صحية واضحة ومنظومة صيدلانية قوية ومتطورة، وعليه فإن وضع نظام قانوني يتماشى مع ظهور هذا النوع من الدواء ليس مسألة بسيطة بل تحتاج إلى وقت طويل وجهد تشريعي كبير لضبط هذا النشاط لأنه متعلق بالنظام العام والصحة العامة لذا كان لزاما تحديد ضوابط قانونية إنتاج وبيع الأدوية الجنيسة، خاصة الحماية المدنية والحماية الجزائية. Résumé : Le médicament générique est un produit pharmaceutique d'une importance capitale pour la santé publique. Il constitue une pierre angulaire de l'économie sanitaire des pays qui ne disposent pas d'un système de recherche fondé sur des bases sanitaires claires et d'un secteur pharmaceutique robuste et développé. Par conséquent, l'élaboration d'un cadre juridique conforme à l'apparition de ce type de médicament n'est pas une tâche simple. Elle nécessite un temps considérable et un effort législatif important pour réguler cette activité, car elle touche à l'ordre public et à la santé publique. Il est donc impératif de définir des régulations légales pour la production et la vente des médicaments génériques, en particulier la protection civile et la protection pénale. Abstract: Generic drugs are pharmaceutical products of great importance that underpin public health. They are a cornerstone of the health economy in countries that lack a research system based on clear health principles and a strong and developed pharmaceutical sector. Therefore, establishing a legal framework that aligns with the emergence of this type of drug is not a simple matter; it requires considerable time and significant legislative effort to regulate this activity because it is related to public order and public health. Thus, it is imperative to define legal regulations for the production and sale of generic drugs, especially civil protection and criminal protection.
