Abstract

الملخص : فرض المشرع الجزائري التزاميين على التاجر و هما : القيد في السجل التجاري،مسك الدفاتر التجاري حيث نظم المشرع هذين الالتزامين في نصوص قانونية نظرا لأهميتهما و تأثيرهما على التجارة و الاقتصاد الوطني بوضع شروط و قواعد ، و بمجرد تنفيذ هته الالتزامات تترتب آثار قانونية أهمها اكتساب صفة التاجر بالنسبة للتاجر و الشخصية المعنوية بالنسبة للشركات ، كما تمنح الملتزم بها حقوق و تعرض المخالف لها لجزاءات مدنية و عقوبات جنائية

Le législateur algérien à organisé ces deux obligation juridiques en raison de leur importance et de leur influence sur le commerce et l’économie nationale en fixant des conditions et des règles , qui ont des implication juridiques, dont les plus importantes sont l’acquisition du caractère de la personne physique et le caractère morale des sociétés, le contrevenant a été soumis à des vois de fait et à des sanctions pénales : Algerian legislatorimposedtwoprofessional obligation on the trader: Regitration in the comercialregister, commercial books.
