Abstract

الملخص: لتنفيذ مختلف المشاريع التنموية في إطار الصفقات العمومية يتمتع المتعامل المتعاقد بمجموعة من الحقوق والالتزامات ،فمن حيث الحقوق فإن المتعامل المتعاقد عندما ينفذ التزاماته المتعلقة بموضوع الصفقة ،صار من حقه الحصول على المقابل المالي بالكيفية التي حددها القانون ،ويجوز له المطالبة بالتعويض إذا لحقت به أضرار جراء عمل قامت به الادارة ،كذالك إذا واجهته ظروف وعوامل مرهقة لا يمكن معها الاستمرار في تنفيذ الصفقة بات من حقه المطالبة بالتوازن المالي للعقد ،هذا إلى جانب امكانية مطالبته بالتعويض عن الأضرار التي أصابه. أما من حيث التزامات المتعامل المتعاقد فإنها تتعدد إزاء المصلحة المتعاقدة ،فهو ملزم بتقديم مختلف الضمانات المنصوص عليها في القانون باعتبارها ضمانات أساسية لحسن تنفيذ بنود الصفقة ،فهو ملزم بأداء الخدمة المتفق عليها مسبقا والمعينة والمحددة بالصفقة وتسليمها في وقتها المحدد.
