المسؤولية الجزائية للطّبيب عن الخطأ المهني

Abstract

الملخص: الطبّ مهنة إنسانية أخلاقية علمية مقدّسة ، لها أهمّيتها الدّائمة وتنشأ على علاقة ما بين المريض والطّبيب ،هي إنسانية بطبيعتها وقانونية تحتّم على الطبيب الإهتمام بالمريض وعمل كل ما يلزم لعلاجه وبذل العناية التي تقتضيها مهنة الطب . ويعتبر الطّبيب مسؤولا جنائيا ،كغيره من الأشخاص إذا ارتكب خطأ أثناء تأدية مهامه ،لأنّ الأعمال الطبيّة تُعدّ إستثناءامن المبدأ العام الذي يقتضي بحرمة المساس بالجسم البشري ،كما أنّ هذه الأعمال مقيّدة بشروط هي التّرخيص القانوني ورضا المريض وقصد العلاج ،فإذا لم تتوفر هذه الشروط عُدّ العمل الطبي غير مشروع ،وأصبح الطبّيب خاضعا للمسؤولية الجنائية . فالمشرّع الجزائري حدّد نطاق المسؤولية الجنائية أو الجرائم التي يمكن أن يرتكبها الطبيب في قانون العقوبات كجريمة الإجهاض وفي قانون حماية الصحة وترقيتها كجريمة نقل الدم الملوّث أو بيعه Résumé : La médecine est une profession déontologique et scientifique très sacrée ayant une importance constante et s’engendrant entre le patient et son médecine. Elle a outre humaine et juridique qui exige du médecin prendre soin de son patient et déployer tous tous les efforts édictés par la profession du médecin. Le médecin a une responsabilité pénale au cas ou il commet une erreur en exerçant sa fonction, Car les interventions médicales sur le corps humain sont considérés, par principe général, comme une exception .Ces interventions médicales sont soumis aux conditions ,a l’instar de l’autorisation légale, l’acquiescement du patient et l’objectif du traitement A défaut ,la pratique de médecine sera considérée illégal et par conséquent le médecin sera soumis a une responsabilité pénale. L’législateur algérien et sélectionnez la page de crimes ou la responsabilité pénale qui peuvent être commises par un médecin dans le code pénale en tant que crime de loi sur l’avortement et la protection de la santé et la santé et les infractions contaminés transfusions Sanguines mises a niveau ou ou de vendre. Summray : Médicine is a moral,scientific ,and humane profession that has permanent importance and arises on a relationship between the patient and the doctor.it is humain in nature and legal,requiring the doctor to take care of the patient and do everything necessary to treat him and give the care required by the medical Profession . And the doctor is considered criminally responsible ,like any other person if he made a mistake while performing his duties ,because medical work is an exception to the general principle that requires the inviolability of the humain body,and these actions are restricted by conditions that are restricted by conditions that are legal authorization and patient satisfaction and intent to tretment ,if not available these conditions are illegal medical work ,and the doctor has become subject to criminal responsibiliy. The Algerian projetc has limited the scope of criminal responsability or crimes that a doctor can commit in the penal code ,such as the crime of aboration and in the law to protect and promote healt shch as the crime of transfusion or sale of contaminated blood .
