محددات تطبيق مبدأ الضرورة العسكرية في القانون الدولي الإنساني

Abstract

الملخص: ان الهدف من هذه الدراسة تبيان الدور والمكانة المهمة لحالة الضرورة العسكرية في القانون الدولي الانساني التي تعد أهم معالمه الأساسية محاولين التوفيق بين مصطلحين متناقضين ألا وهما المتطلبات الأساسية وحالة الضرورة العسكرية التي تعد ظرفا استثنائيا مؤقتا تطرأ ضمن ظروف محصورة ومقيدة بشروط نسبة الى صكوكها القانونية المشرعة لها وتمارس في إطار متطلبات الانسانية. Résumé : Cette étude a pour objectif de démontrer le rôle et le statut important de l’état de la nécessité militaire dans le droit international humain dont elle est piliers on essayera de rapproche entre deux nations contradictoires à savoir les exigences fondamentales de l’état de nécessitémilitaire qui est un étatprovisoire et exceptionnel qui surgit dans des conditions restreintes et biendéterminées par des instruments légaux et exercé dans le cadre des exigences humaines.
