الرقابة على دستورية القوانين دراسة مقارنة الجزائر-فرنسا

Abstract

Abstract : The oversight of the constitutionality of lows is considered the actual tool for establishing the principle of the supremacy of the constitution and preventing the issuance of laws that conflict with its provisions, it has witnessed remarkable development through successive constitutions، whether in Algeria or France. A specialized body for constitutional oversight was established, with the adoption of prior and subsequent oversight, it grants sitizens the right to challenge the unconsititutionality of legal texts that may violate their rights and freedoms. In france،a constitutional council was established that also specializes in prior and subsequent oversight, where the issue of constitutional priority was included so that individuals can initiate constitutional oversight. Despite the differences between the Algerian and Franch experiences, Algeria followed in the footsteps of France, which had preceded it in the field of constitutional oversight. الملخص: تعتبر الرقابة على دستورية القوانين الأداة الفعلية لتكريس مبدأ سمو الدستور والحيلولة دون صدور قوانين تتعارض مع أحكامه. حيث عرفت تطورا ملفتا عبر الدساتير المتعاقبة سواء في الجزائر أو فرنسا، حيث تم انشاء هيئة مختصة بالرقابة الدستورية في الجزائر" المحكمة الدستورية"، مع اعتماد الرقابة القبلية والبعدية، حيث منح الحق للمواطنين بالطعن في عدم دستورية نصوص قانونية قد تنتهك حقوقهم وحرياتهم، أما في فرنسا فقد أنشئ مجلس دستوري يختص كذلك بالرقابة القبلية والبعدية حيث تم ادراج" المسألة الأولوية الدستوري" ليتمكن الأفراد من تحريك الرقابة الدستورية. رغم وجود فروقات بين التجربتين الجزائرية والفرنسية إلا أن الجزائر سارت على خطى فرنسا التي كانت قد سبقتها بخطوات في مجال الرقابة الدستورية.
