Abstract

الملخص: عندما تبرز حالات الطوارئ لوجود تهديد حال ضد الدولة فإنه تمنح للسلطة التنفيذية صلاحيات واسعة من شأنها أن تؤدي إلى تعطيل و تقييد الحقوق و الحريات العامة و هذا في سبيل حماية النظام العام، لذلك تم وضع حدود و ضمانات تمنع الاعتداءات غير المبررة على حريات و حقوق الأفراد. وتعرف حالة الطوارئ بأنها نظام استثنائي تفرضه السلطات العليا في الدولة أثناء حدوث خطر داخلي أو خارجي يهدد المؤسسات الدستورية في البلد أو أمن و سلامة المواطنين أو الإقليم الوطني و يهدف هذا النظام الاستثنائي إلى استتباب النظام العام. L état d'urgence est définie comme un régime exceptionnel exigé pour les hauts autorité de l état en cas de danger interne externe qui vise les institut constutionnelles du pays, ou la sécurité dés citoyens ou le territoire national et ce régime dérogatoire vise à rétablir l ordre public. summary: When emergency situations arise because of a threat against the state, it gives the executive authority broad powers that would lead to the disruption and restriction of rights and public freedoms. This is in order to protect the public order. There fore, limits and guarantees have been established to prevent unjustified attacks on the freedoms and rights of individuals . The state of emergency is defined as an exceptional regime imposed by the supreme authorities of the State in the event of an internal or external danger that threatens the constitutional institutions of the country or the security and safety of citizens or the national territory. This exceptional system aims to establish public order.
