مبـدأ التّسويـة الودّيـة لمنازعات الصّفقات العموميـّة

Abstract

الملخص : لقد منح المشرع الجزائري مكانة خاصة للصفقات العمومية لما لها من أهمية كبرى على الاقتصاد الوطني وهذا ما شد انتباهنا من خلال سلسلة التعديلات المتتالية لهذا القانون، إذ تعد التسوية الودية لمنازعات الصفقات العمومية بوسائلها المختلفة من الطرق الهامة في معالجة الخلافات المرتبطة بإبرام وتنفيذ الصفقات العمومية سواء ارتبط الأمر مع المتعاملين الاقتصاديين الجزائريين أو مع المتعاملين الاقتصاديين الأجانب . فاهتمام المنظم الجزائري بالتسوية الودية لمنازعات الصفقات العمومية يأتي بغية بحثه على حل للنزاع وذلك بأقل التكاليف وفي أسرع وقت مع احترام المدة المحددة لإنجاز موضوع الصفقة . .

Résumé : Le régulateur algérien a accordé un statut particulier aux marché publiques en raison de leur grande importance pour l’économie nationale. Et c’est ce qui a attiré notre attention à travers une série d’amendements successifs à cette loi , Le règlement à l’amiable des différends relatifs aux transactions publiques par ses divers moyens est un moyen important de traiter les différences associées à la conclusion et à la mise en œuvre des transactions publiques . Qu’il s’agisse de négociants économiques algériens ou de négociants économiques étrangers , l’intérêt du régulateur algérien pour le règlement à l’amiable des litiges relatifs aux transactions publiques vise à rechercher une solution au moindre coût et dans les meilleurs délais , tout en respectant le délai de réalisation de l’objet de l’opération .

Summary: The algerian regulator has given a special status to market public because of their positive impact on the national economy , and this is what caught our attention through a bunch of amendments to this law . The amicable settlement of public procurement disputes by its various means is one of the important ways in dealing with disputes related to the conclusion and exucution of public deals , whether it is related to algerian economic operators or with foreign economic operators . The algerian regulator’s interest in the amicable resolve of public procurement disputes comes with the aim of seeking a solution to the dispute , at the lowest costs and in the fastest time , while respecting the specified period for the completion of the subject of the deal . :
