Abstract

ملخص: إنّ سلطات الضبط الإداري المخولة قانونا تسعى للحفاظ على النظام العام بواسطة وسائل مادية وقانونية تتناسب مع الوضع المراد استتبابه في ظل الظروف العادية، فينجم عنه تقييد لبعض الحريات، لكن قد تصيب الدولة ظروف استثنائية، لتتولى سلطات الضبط المخولة قانونا حماية النظام العام مقيدةً الحقوق والحريات الفردية والجماعية، لكن المشرع الجزائري كفل حماية هذه الحقوق والحريات من خلال ضمانات تتمثل في الرقابة البرلمانية، والإدارية، والقضائية وكذا رقابة الرأي العام.
