العلاقة بين السلطة التنفيذية و السلطة التشريعية في ظل التعديل الدستوري الجزائري 2020

Abstract

الملخص: من خلال تحليل أحكام التعديل الدستوري 2020، يتبين أن المؤسس الدستوري كرس تفوق السلطة التنفيذية لاسيما من خلال تعزيز صلاحيات رئيس الجمهورية في مواجهة البرلمان، سواء عبر تدخله في المجال التشريعي أو من خلال احتفاظه بصلاحية حل المجلس الشعبي الوطني. وفي المقابل حرص المؤسس الدستوري على ضمان الدور الرقابي للسلطة التشريعية رغم الطابع شبه الرئاسي للنظام السياسي الذي تبناه التعديل الدستوري لسنة 2020. Résumé : L'analyse des dispositions de l'amendement constitutionnel de 2020 révèle que le fondateur de la Constitution a consacré la suprématie du pouvoir exécutif, notamment en renforçant les pouvoirs du Président de la République sur le Parlement, tant par son intervention dans le domaine législatif que par le maintien du pouvoir de dissoudre l'Assemblée populaire nationale. À l'inverse, le fondateur de la Constitution a tenu à garantir le rôle de contrôle du pouvoir législatif, malgré le caractère semi-présidentiel du système politique adopté par l'amendement constitutionnel de 2020. Abstract: By analyzing the provisions of the 2020 constitutional amendment, it becomes clear that the constitutional founder established the supremacy of the executive branch, particularly by strengthening the powers of the President of the Republic vis-à-vis Parliament, both through his intervention in the legislative sphere and by retaining the power to dissolve the National People's Assembly. Conversely, the constitutional founder was keen to ensure the oversight role of the legislative branch, despite the semi-presidential nature of the political system adopted by the 2020 constitutional amendment.
