المسؤولية المدنية للصيدلي عن إخلاله بالإلتزام بالإعلام

Abstract

الملخــــــــــــــــص: يرتكب الصيدلي كغيره من المهنيين أخطاء تثير مسؤوليته المدنية التي تقوم على دعائم أساسية من خطأ وضرر وعلاقة سببية. فتتعدد الأخطاء الصادرة من الصيدلي بتعدد الإلتزامات المفروضة عليه، أهمها الإلتزام بالإعلام أي إعلام المستهلك وتقديم له المعلومات عن المستحضر الصيدلاني. كما أن المسؤولية التي يتحملها الصيدلي ليست فقط على أخطائه الشخصية بل تمتد لتشمل الأخطاء الصادرة من مساعديه وفي حالة قيام المسؤولية المدنية للصيدلي فهو ملزم بالتعويض، غير أنه يمكنه الدفع بالمسؤولية إما لأسباب عامة أو لأسباب خاصة وبالتالي تنتفي مسؤوليته. Résumé: Le pharmacien, comme les autres professionnels, commet des erreurs qui engagent sa responsabilité civile, laquelle repose sur les piliers fondamentaux de l'erreur, du dommage et de la causalité. Les erreurs commises par le pharmacien sont multipliées par la multiplicité des obligations qui lui sont imposées, dont la plus importante est l'obligation d'informer, c'est-à-dire d'informer le consommateur et de lui fournir des informations sur le produit pharmaceutique. Aussi, la responsabilité du pharmacien n'est pas seulement pour ses fautes personnelles, mais s'étend aux fautes commises par ses assistants.Dans le cas où le pharmacien a une responsabilité civile, il est obligé d'indemniser, mais il peut payer la responsabilité soit pour des raisons publiques ou pour des raisons privées, et donc sa responsabilité est niée.

Abstract: The pharmacist, like other professionals, commits errors that raise his civil liability, which is based on basic pillars of error, damage and causation. The errors issued by the pharmacist are multiplied by the multiplicity of obligations imposed on him, the most important of which is the obligation to inform, that is, inform the consumer and provide him with information about the pharmaceutical product. Also, the responsibility of the pharmacist is not only for his personal mistakes, but extends to include the mistakes made by his assistants. In the event of the civil liability of the pharmacist, he is obligated to compensate, but he can pay the responsibility either for public reasons or for private reasons, and therefore his responsibility is negated.
