Abstract

ملخص: إن نزع الملكية للمنفعة العامة يعتبر من أهم مواضيع القانون الإداري التي لم تحظ بالاهتمام الواسع بالمواضيع الإدارية الأخرى، بحيث أن إجراء نزع الملكية للمنفعة العامة يعتبر بمثابة إجراء استثنائي يقضي بسحب حق الملكية من صاحبها لصالح الدولة أو المجتمع وهذا مقابل تعويض عادل، وبالتالي يجوز لصاحب الشأن بتقديم طعن حول القرار الصادر بتقرير المنفعة العامة. Résumé: La dépossession de la propriété pour l'intérêt général est l'un des sujets les plus importants du droit administratif qui n'a pas bénéficié d'une attention aussi large que d'autres sujets administratifs, de sorte que la procédure de dépossession de la propriété pour l'intérêt général est considérée comme une mesure exceptionnelle consistant à retirer le droit de propriété de son propriétaire au profit de l'État ou de la société en échange d'une compensation équitable. Par conséquent, le concerné est autorisé à contester la décision prise sur la détermination de l'intérêt général. Abstract: The expropriation of property for public benefit is considered one of the most important topics in administrative law that has not received wide attention compared to other administrative issues, as the process of expropriation for public benefit is seen as an exceptional measure that involves withdrawing ownership rights from the owner in favor of the state or society in return for fair compensation. Therefore, the concerned party has the right to challenge the decision made regarding the determination of public benefit.
