بيع ملك الغير في القانون المدني الجزائري

Abstract

ملخص يصدر بيع ملك الغير من غير المالك،ينص على الأشياء المعينة بالذات المملوكة لغير البائع و هذا ما أدرج في القانون الوضعي على خلاف الفقه الإسلامي الذي نظمه تحت عنوان الفضولي. و تترتب أثار في هذا البيع في ما بين المتعاقدين التي تكمن في أحقية المشتري بطلب الإبطال حتى و لو كان سيئ النية،و أثار بالنسبة إلى المالك الحقيقي الذي لا يسري هذا البيع في حقه باعتباره أجنبيا عن العقد إلا إذا أقره يصبح هذا البيع ساريا في حقه و يسقط حق المشتري في طلب الإبطال.

Résumé La vente des biens d'un tiers autre que le propriétaire doit être émise, prévoyant les objets particuliers appartenant au non-vendeur, et cela est inclus dans le droit positif contraire à la jurisprudence islamique, organisé sous le titre de curiosité. Dans cette vente, il y a une différence entre les entrepreneurs qui sont dans le droit de l'acheteur de demander la révocation même s'il s'agit d'une mauvaise intention et qui soulignent pour le propriétaire réel que cette vente ne s'applique pas à lui en tant qu'étranger pour le contrat. Sauf approbation, la vente devient valide. Et le droit de l'acheteur de demander la révocation sera annulé.

Summary The sale of the property of a third party other than the owner must be issued, providing for the particular objects belonging to the non-seller, and this is included in the positive law contrary to Islamic jurisprudence, organized under the title of curiosity. In this sale, there is a difference between the contractors who are in the right of the buyer to ask for the revocation even if it is a bad intention and which underline for the real owner that this sale is not not apply to him as a foreigner for the contract. Unless approved, the sale becomes valid. And the right of the buyer to request the revocation will be canceled.
