ذاتية النظام القانوني للسفينة

Abstract

الملخص : إن إعتبار السفينة الأداة الرئيسية للملاحة البحرية و بالتالي الوسيلة الأساسية في التجارة الدولية يجعل منها ذات قيمة باهضة و دور هام في المجال الاقتصادي لدى الدول قاطبة ، كنتيجة لذلك دأبت معظم التشريعات على إحاطتها بنظام قانوني خاص بها ، فنجدها من جهة تخضع لأحكام المنقول تـارة و لأحكـام العقار تـارة أخرى ، و من جهة ثانية نجد في بعض الإجراءات الخاصة بها و الشبيهة بالأشخاص على غرار نظام الحالة المدنية و الجنسية ، و هو ما أخذ به المشرع الجزائري من خلال أحكام القانون البحري الجزائري . Summary : The consideration of the ship as the main tool for maritime navigation and therefore the primary means of international trade makes it of great amount and an important role in the economic field in all countries , So most of the legislations have always framing it with a legal system of its own, so we find it on the one hand subject to the provisions of the movable and sometimes to the provisions of real estate at other times, and on the other hand, we find in some special procedures that are similar to people, similar to the civil status and nationality system, which is what the Algerian legislator adopted through the provisions of the Algerian maritime law. Résume: Le navire est l'outil principal de la navigation maritime , et donc le principal moyen du commerce international le rend d'une grande valeur et un rôle important dans le domaine économique dans tous les pays, donc la plupart des législations l'ont toujours entouré d'un système juridique qui lui est propre, nous le trouvons donc d'une part soumis aux dispositions du mobilier et parfois aux dispositions de l'immobilier. A d'autres moments, et d'autre part, on retrouve dans certaines procédures spéciales qui s'apparentent aux personnes, similaires au système de l'état civil et de la nationalité, ce que le législateur algérien a adopté à travers les dispositions de la loi maritime algérienne.
