البنية القانونية للمؤسسات الناشئة في الجزائر

Abstract

الملخص بهدف إنجاح فكرة المؤسسات الناشئة في الجزائر عمد المشرع الجزائري إلى تنظيمها بنصوص قانونية تتماشى و خصائصها و ذلك من خلال تنظيم الحصول على علامة مؤسسة ناشئة و إستحداث شكل شركة مساهمة بسيطة كما سخر لها آليات لمرافقتها من بداية تبلور الفكرة في ذهن صاحبها إلى غاية خروجها إلى عالم الشغل لتصبح مؤسسة قائمة بذاتها ، قسم المشرع هذه الآليات إلى أجهزة التمويل تتكفل بتقديم المساعدة المالية ، وأخرى مهمتها دعم أصحاب الأفكار المبتكرة القابلة للتطور لتصبح مؤسسة ناشئة. Summary In order to make the idea of emerging enterprises successful in Algeria, the Algerian legislator decided to regulate them with legal texts consistent with their characteristics, by regulating the acquisition of the emerging enterprise mark and creating the form of a simple joint-stock company. He also provided mechanisms to accompany it from the beginning of the crystallization of the idea in the mind of its owner until it emerges into the world. To enable employment to become an independent institution, the legislator divided these mechanisms into financing bodies responsible for providing financial assistance, and others whose mission is to support those with innovative ideas that can be developed into an emerging institution. Résumé Afin de faire réussir l'idée des entreprises émergentes en Algérie, le législateur algérien a décidé de les encadrer par des textes juridiques conformes à leurs caractéristiques, en réglementant l'acquisition de la marque d'entreprise émergente et en créant la forme d'une société par actions simple. Il a également prévu des mécanismes pour l'accompagner depuis le début de la cristallisation de l'idée dans l'esprit de son propriétaire jusqu'à son émergence dans le monde. Pour permettre à l'emploi de devenir une institution indépendante, le législateur a divisé ces mécanismes en organismes de financement chargés de l'assurer. une aide financière, et d'autres dont la mission est de soutenir ceux qui ont des idées innovantes qui peuvent devenir une institution émergente.
