حرمة الحياة الخاصة في القانون الجنائي

Abstract

ملخص المذكرة يعدّ الحق في حرمة الحياة الخاصة من الحقوق الشخصية البالغة الأهمية، أقرّته مختلف التشريعات الوضعية وكفلت له الحماية، ونظرا لبعض التطورات الحاصلة ومن تغير بعض المفاهيم داخل المجتمع ممّا نجم عنه حصول انتهاكات لهذا الحق؛ إذ تيسر الوصول إلى خصوصيات الفرد الأمر الذي نتج عنه خلق مشاكل اجتماعية وقانونية داخل المجتمع، وهنا يأتي دور المشرع الجزائي الذي أقرّ حماية جزائية نوعية لحق الشخص في حرمة حياته الخاصة. Abstract The right to privacy is one of the most important rights of the individual. Aadopted by various positive legislations and guaranteed protection, give some developments and the change in some concepts within society resulting in violations of this right by facilating access to one’s privacy, which has resulted in social and legal problems within society; this is the role of a penal legislator who has established a specific penal protection of a person’s rights to privacy. Résumé Le droit à la vie privée est l'un des droits les plus importants de l'individu. Adopté par diverses législations positives et garanties de protection, donner quelques évolutions et le changement de certains concepts au sein de la société entraînant des violations de ce droit en facilitant l'accès à sa vie privée, ce qui a entraîné des problèmes sociaux et juridiques au sein de la société ; c'est le rôle d'un législateur pénal qui a établi une protection pénale spécifique du droit à la vie privée d'une personne.
