آليات حماية البيئة في ظل النزاعات المسلحة

Abstract

الملخص: تعد قضية حماية البيئة أثناء النزاعات المسلحة من القضايا المستحدثة والمهمة في القانون الدولي، وخاصة لكثرة ما تعرضت له البيئة من دمار بسبب الحروب والنزاعات المسلحة، فالواقع يبين أن الحروب التي شهدتها وتشهدها الساحة الدولية أدت إلى انتهاك حق من حقوق الانسان الأساسية وهو حق العيش في بيئة سليمة ونظيفة، لذا كان من المحتوم حماية الموارد الطبيعية كونها تمثل إرثا للأجيال وتراثا طبيعيا وتاريخيا للدول من خلال مناقشة أحكام القانون الدولي الإنساني التي تهدف إلى حماية البيئة زمن النزاعات المسلحة.

Résumé La protection de l'environnement, pendant les conflits armés, est considérée comme l'un des principaux sujets d'investigation, en particulier dans le domaine du droit international. L'environnement souffre des conséquences des guerres et des conflits. La réalité souligne que les guerres existantes dans le monde d'aujourd'hui violent le droit essentiel de l'homme de vivre dans un environnement purement propre. La protection des ressources naturelles était donc une priorité, car elles symbolisent à la fois un patrimoine riche pour la génération actuelle et un patrimoine naturel et historique. . Les pays travaillent en collaboration à la promulgation de lois relatives aux lois humaines internationales visant à préserver l'environnement de toutes sortes de menaces.

Abstract The protection of the environment, during armed conflicts, is considered as one of the most important topics under investigation, especially in the domain of international law. The environment is suffering from the outcomes of wars and conflicts. Reality stresses out that the wars existing in today's world are violating humans' essential right to live in a purely clean environment, so protecting the natural resources was a priority since they symbolize a rich patrimony for the current generation as well as a natural and historical one. Countries are collaboratively working on the enactment of laws related to the international human laws that aim at preserving the environment from all sorts of threats.
