النظام القانوني لعقد العمل الرياضي

Abstract

ملخص تتناول هذه المذكرة موضوع "عقد العمل الرياضي"، اذ تهدف الى تسليط الضوء على الجوانب القانونية التي تحكم مثل هذه العقود في المجال الرياضي خاصة في الجزائر، وهذا من خلال تحليل العقود الرياضية من حيث الناحية القانونية ومعرفة القوانين واللوائح المعمول بها ضمن هذا المجال. حيث أن عقد العمل الرياضي هو عقد شكلي ، محدد المدة و ملزم للجانبين، كما أنه عقد عمل يتسم بالمرونة و الحركة ، كما يتميز بالخصوصية و التي تتمثل في خضوعه لقانون العمل إضافة إلى خضوعه للقانون المدني كونه عقد عمل ، زد على ذلك خضوعه لقواعد الاحتراف الصادرة عن الاتحادات في المجال الرياضي ، و في حالة وجود نزاع بين طرفي هذا العقد يحل أولا بالطرق الودية على مستوى الهيئات الرياضية سواء الدولية أو المحلية ، أما إذا ما لم يتم حل النزاع فيتم عرضه للقضاء ،و ينقضي عقد العمل الرياضي بانتهاء أجله و ذلك بإنجاز العمل المتفق عليه ، كذلك ينقضي عند وجود أسباب طارئة أو بالإرادة المنفردة لأحد الطرفين عند إخلال الطرف الآخر بالتزامه .

Résumé Ce mémorandum traite du thème du "contrat de travail sportif", car il vise à éclairer les aspects juridiques régissant de tels contrats dans le domaine du sport, notamment en Algérie, à travers l'analyse des contrats sportifs d'un point de vue juridique et la connaissance des lois et règlements applicables dans ce domaine. Le contrat de travail sportif étant un contrat formel, à durée déterminée et contraignant pour les deux parties, il s'agit également d'un contrat de travail caractérisé par la flexibilité et la mobilité, il se caractérise également par sa spécificité, qui consiste en sa subordination au droit du travail en plus de sa subordination au droit civil en tant que contrat de travail, en plus de sa subordination aux règles de professionnalisme édictées par les fédérations dans le domaine sportif, et en cas de litige entre les parties à ce contrat, il est d'abord résolu à l'amiable au niveau des instances sportives, qu'elles soient internationales ou locales, mais si le litige n'est pas résolu, il est soumis à la justice, et le contrat de travail sportif expire à la fin de sa durée, en achevant le travail il expire également lorsqu'il y a des raisons d'urgence ou par la seule volonté de l'une des parties lorsque l'autre partie viole son obligation .

Sumary This memorandum deals with the topic of "sports employment contract", as it aims to shed light on the legal aspects governing such contracts in the sports field, especially in Algeria, through analyzing sports contracts from a legal point of view and knowledge of the applicable laws and regulations within this field. As the sports employment contract is a formal, fixed-term and binding contract for both sides, it is also an employment contract characterized by flexibility and mobility, it is also characterized by specificity, which consists in its subordination to the labor law in addition to its subordination to the civil law as an employment contract, in addition to its subordination to the rules of professionalism issued by federations in the sports field, and in the event of a dispute between the parties to this contract, it is first resolved amicably at the level of sports bodies, whether international or local, but if the dispute is not resolved, it is submitted to the judiciary, and the sports employment contract expires at the end of its term, by completing the work it also expires when there are emergency reasons or by the sole will of one of the parties when the other party violates its obligation .
