الإشكالات المرتبطة بعملية التلقيح الاصطناعي

Abstract

الملخص: يعدّ التلقيح الاِصطناعي من التقنيات ذات الأهمية الكبيرة، التي تضمن في كثير من الأحيان استقرار العلاقات الزوجية، باعتباره وسيلة لعلاج العقم والحد من المشاكل الاجتماعية والنفسية، والمعترف به من قبل المشرع بموجب نص المادة 45 مكرر من الأمر 05/02، حيث أجاز اللجوء إلى التلقيح الاصطناعي وفق ضوابط المتمثلة في: أن يكون الزواج شرعيا، وان يتم برضا الزوجين، وأثناء حياتهما، وأن يتم بمني الزوج وبويضة الزوجة، ومنع اللجوء للأم البديلة نظرا للمشاكل التي قد يقع فيها المولود من حيث إثبات أو نفي نسبه، كما قد تؤثر على مستوى قانون الأسرة أو قانون العقوبات. Résumé: L'insémination artificielle est l'une des technique de grande impotance qui garantit souvent la stabilité des relations conjugales comme moyen de traiter l'infertilité. La joue est l'un des problémes sociaux et psychologiques et est reconnue par le législateur en vert du texte de l'article 45 bis 05/02 lorsqu'il a autorisé le recours a l'insémination artificielle selon les controles. De que le mariage est légal, qu'il a lieu avec le consentement des epoux et au cours de leur vie et qu'il a lieu avec le sperme du mari et l'ovule de la femme, et l'interdiction de recourir a la mére porteuse en raison des problémes dans lesquels le nouveau-né peut tomber en termes de preuve ou de refus de sa lignée et peut affecter le niveau du droit de la famille ou du code pénal. Abstract: Artificial insemination is one of the technique of great importance that often guarantees the stability of marital relations as a means for treating infertility, the cheek of social and psychological problems and is recognized by the legislator according to the text of Article 45 bis 05/02 where he authorized the use of artificial insemination according to the controls of: that the marriage is legal; that is takes place with the consent of the spouses and during their life and that it takes place with the husband's sperm and the wife's egg, and the prohibition of resorting to the surrogate mother due to the problems that the newborn may fall into is terms of proving or denying his lineage and may affect the level of family law or the penal code.
