الحماية الدولية للبيئة في زمن النزاعات المسلحة

Abstract

الملخص: إن مسألة حماية البيئة من المسائل التي لقيت اهتماما من قبل المجتمع الدولي باعتبارها الوسط الذي يعيش فيه الإنسان، لكن بالرغم من هذه الأهمية القصوى، إلا أنّها تتعرّض لانتهاكات مستمرة زمن النزاعات المسلحة. و هذا ما جعل القانون الدولي الإنساني يؤكد على ضرورة حمايتها من الأضرار التي قد تلحق بها من خلال القواعد الإتفاقية و مبادئه الأساسية، بالإضافة إلى إقرار المسؤولية الدولية عن الإنتهاكات التي تصيب البيئة. Résumé : La question de la protection de l’environnement est l’une des questions qui ont retenu l’attention de la communauté internationale, car c’est le milieu dans lequel les gens vivent, mais malgré cette importance capital, elle fait l’objet de violations continues pendant les conflits armés, c’est ce qui fait que le droit internationale humanitaire insiste sur la nécessité de la protéger des dommages qui pourraient lui être causés par les règles et les principes fondamentaux de la convention, en plus de reconnaitre la responsabilités internationale pour les violations qui affectent l’environnement . Abstract : The issue of protecting the Environment is one of the issues that have received attention from the intenational community as it is the medium in which people live, but despit this utmost importance, it is subject to continuos violations during armed conflicts . this is what makes international humanitarian law stress the need to protect it from the damage that may be caused to it through the rules and basic principles of the convention, in addition to recognizing international responsibility for violation that affect the environment.
