ضمانات نفاذ القاعدة الدستورية في الجزائر

Abstract

الملخص إنّ القواعد الدستورية باعتبارها القاعدة الأساسية التي يرتكز عليها النظام القانوني و السياسي، فذلك يفرض وجوب احترامها من طرف جميع السلطات الأساسية الثلاث داخل الدولة، حيث يجب على هذه السلطات التقيّد بأحكام هذه القواعد و نصوصها عند ممارسة صلاحياتها و وظائفها، و لضمان نفاذ القواعد الدستورية و حمايتها من الاعتداء على قواعدها كرّس المؤسس الدستوري آليات رقابة قانونية تتمثّل في الرقابة المتبادلة بين السلطة التشريعية و التنفيذية، لكنّها تبقى غير فعّالة نتيجة القيود الواردة على تحريك المسؤولية السياسية للحكومة و الرقابة على دستورية القوانين و التي أدخل عليها المؤسس الدستوري في التعديل الدستوري لسنة 2020 إصلاحات على مستوى المحكمة الدستورية. Résumé Les règles constitutionnelles, étant la règle de base sur laquelle se base le système juridique et politique, exigent qu'elles soient respectées par les trois autorités de base au sein de l'État, car ces autorités doivent se conformer aux dispositions et aux textes de ces règles dans l'exercice de leurs pouvoirs et fonctions, et pour assurer l'application des règles constitutionnelles et le protéger contre l'atteinte à ses règles, le Fondateur constitutionnel a établi des mécanismes de contrôle juridique représentés dans un contrôle mutuel entre les autorités législatives et exécutives, mais ils restent inefficaces en raison des restrictions à la circulation de la responsabilité politique du gouvernement et le contrôle de la constitutionnalité des lois, que le Fondateur constitutionnel a introduit dans l'amendement constitutionnel des réformes de 2020 au niveau de la Cour constitutionnelle. Abstract The constitutional rules, being the basic rule on which the legal and political system is based, require that they be respected by the three basic authorities within the State, since these authorities must comply with the provisions and texts of these rules in the exercise of their powers and functions, and to ensure the application of the constitutional rules and to protect it against infringement of its rules, the Constitutional Founder has established mechanisms of legal control represented in a mutual control between the authorities legislative and executive, but they remain ineffective due to the restrictions on the flow of political accountability of government and the review of the constitutionality of laws, which the Constitutional Founder introduced in the Constitutional Amendment of the 2020 Court-Level Reforms constitutional.
