جرائم العنف ضد الزوجة في التشريع الجزائري

Abstract

ملخص: لعل الناظر في قانون العقوبات الجزائري قبل صدور قانون 15/19 يلحظ أن المشرع قد أصبغ الحماية الجنائية للمرأة بشكل عام من دون تحديد ولا تخصيص الأمر الذي أثار العديد من الإشكالات فيما يخص ترك المجال فارغا لبعض السلوكات إلى لم يكن المشرع قد أدخلها ضمن المحظورات ولعل من بين تلك السلوكات ما يمس الزوجة على وجه الخصوص، إذ نجد أن المشرع ضمن التعديل الأخير لقانون العقوبات (رقم 1519) قد تفادي ذلك النقض في نصوص التجريم ومنه في الحماية بالنص صراحة على تحريم بعض السلوكات التي يمارسها الزوج على زوجته والتي من شأنها أن تكون مساسا بالجانب المادي لها (الجسدي) أو بالجانب المعنوي. Résumé: Le droit pénal en Algérie avant la promulgation de la loi 15-19 assure la protection pour la femme d'une façon générale, ce qui a provoqué plusieurs problématiques notamment avec les lacunes non traitées par la législation comme des prohibitions qui touchent entre autres à la femme mariée. La loi 15.19 a comblé les failles juridiques caractérisant l'incrimination dans ce contexte ; cela se fait par la protection directe et expresse par des textes prévoyant l'incrimination de certaines pratiques exercées par le conjoint sur sa femme, qui pourraient être corporelles matérielles ou bien morales immatérielles. Summary: The criminal law in Algeria before the promulgation of Law 15-19 provides protection for women in a general way, which has caused several problems including the gaps not covered by the law as prohibitions that affect inter alia to the married woman. Law 15.19 has filled the legal loopholes characterizing criminalization in this context; this is done by the direct and express protection by texts providing for the incrimination of certain practices exercised by the spouse over his wife, which could be material bodily or immaterial morals.
