Abstract

ملخص: تعدّ فكرة الانحراف التشريعي في استعمال السلطة التشريعية نَظريّة متكاملة وهي تشكل أحد أهم أوجه عدم الدستورية , الهدف من طرحها التوسيع من نطاق الرقابة على دستورية القوانين ذلك لان عيب الانحراف التشريعي يتعلق أساساً بالغاية من التشريع.

Résume L'idée d'une déviation législative dans l'utilisation du pouvoir législatif est une théorie intégrale et l'un des aspects les plus importants de l'inconstitutionnalité. L’objectif est d’élargir le champ du contrôle sur la constitutionnalité des lois, car le défaut de déviation législative est principalement lié à l’objet de la législation.

Abstract: The idea of legislative deviation in the use of the legislative authority is an integral theory and it is one of the most important aspects of unconstitutionality . The purpose of this is to extend the scope of supervision over the constitutionality of the laws because the defect of legislative deviation is mainly related to the purpose of the legislation.
