وسائل إثباث الملكية العقارية في التشريع الجزائري

Abstract

ملخص: لقد نص المشرع الجزائري على حماية الملكية العقارية الخاصة وحدد وسائل إثباتها قبل وبعد صدور الأمر التشريعي المؤرخ في 15/12/1970 والمتضمن قانون الثوتيق والمطبق إبتداءا من 01/01/1971. فجعل العقد العرفي الثابت التاريخ والمحرر قبل صدور الأمر التشريعي المؤرخ في 15/12/1970 السابق ذكره وسيلة لإثبات الملكية العقارية أما بعد صدور هذا القانون فلا يعتد إلا بالسندات الرسمية المشهرة والدفاتر العقارية.

Résumé : Le législateur algérien a prévu la protection des biens immobiliers privés et déterminé les moyens de preuve avant et après la publication de l’ordre législatif du 15/12/1970, qui comprend la loi des cueilleurs et qui a été appliqué à compter du 1/1/1971. Le contrat coutumier fixe, daté et publié avant la promulgation du décret législatif du 15/12/1970 mentionné ci-dessus, est un moyen de prouver la propriété immobilière, mais à compter de la date d'émission de cette loi, seuls les documents officiels enregistrés et les livrets immobiliers sont valables.

Abstract : The Algerian legislator provided for the protection of private real estate and determined the means of proof before and after the publication of the legislative order of 15/12/1970, which includes the law of the pickers and which was applied from 1 / 1/1971. The customary contract fixed, dated and published before the promulgation of the legislative decree of 15/12/1970 mentioned above, is a means of proving real estate ownership, but from the date of issuance of this law, only the documents registered officials and the real estate booklets are valid.
