السلطة التنفيذية في الجزائر دراسة في ظل التعديل الدستوري لسنة 2020

Abstract

الملخص: مقارنة بالسلطات الأخرى، تحتل السلطة التنفيذية مكانة هامة في النظام السياسي الجزائري، فقد تبنى المؤسس الدستوري إزدواجية السلطة التنفيذية في 1989، وكذلك الشأن بالنسبة لجميع الدساتير اللاحقة وصولاً إلى التعديل الدستوري لسنة 2020. وتعرض الدراسة الحالية التعديلات التي طرأت على السلطة التنفيذية، فيما يخص الشروط المستحدثة للمترشح لمنصب رئيس الجمهورية، وكذا مختلف الصلاحيات التي عهدها له المشرع، والتي تبين مدى إستحواذ رئيس الجمهورية على هذه السلطة مقارنة بإختصاصات الوزير الأوّل، التي تقلصت وبذلك أصبح في مرتبة تبعية، ويبقى مجرد منفذ ومنسق لبرنامج الرئيس، كما تبين لنا هذه الدراسة تدخل السلطة التنفيذية في عمل السلطتين التشريعية والقضائية، وكذلك تدخل الأخيرتين وهيمنتها على جميع السلطات في عمل الجهاز التنفيذي، من خلال مجموعة من النصوص الدستورية. Résumé: Par rapport aux autres autorités, le pouvoir exécutive occupe une place importante dans le système politique algérien, le fondateur constitutionnel ayant adopté une dualité du pouvoir exécutif en 1989, il en va de même pour tous les constitutions ultérieures jusqu'a l'amendement constitutionnel de 2020. La présente étude présente les nidification apportées au pouvoir exécutive en le qui concerne les nouvelles conditions du candidatât aposte de président de la république, ainsi que différent pouvais qui lui sont confiés par le législateur, ce qui n’outre à quelle point dont le président de la république a acquis le pouvoir par rapport auxésis compétences du premier ministre qui entête réduites, ainsi il est devenu un subordonné, et reste seulement un exécutants et un conciliateur du programme du président. Comme cette étude montre la domination du pouvoir exécutif sur toutes les autorités dans la mesure ou il dans le travail des autorités législatives et judiciaires, ainsi que l’ingérence de les claviers dans le travail de l’exécutif à travers un ensemble de textes constitutionnels. Abstract: Compared to other authorities, the executive power occupies an important place in the Algerian political system, the constitional founder having adopted a duality of executive power in 1989, the some goes for all subsequent constitution until the constitution amendment of 2020. This study presents the changes ! to the executive power with regard to the new conditions of the candidate for the post of president of the republic as well as the deferent powers entrusted to him by the legislator, which shows to what extent the president of the republic has acquired the ponder in relation to the powers of the prime minister which have been reduced, hauls he became a subordinate, and remains only au executor a coordinator of the president’s program. As this stocky shows us the domination of the executive power outer all the authorities insofar as it interferes in the work of the legislate and judicial authorities, as well as the interference of the latter in the work of the executive through whole of constitutional texts.
