Abstract

الملخص: يعتبر التحقيق الاداري دعامة قوية لمسار المنازعة الادارية وفاصلا مميزا عن المنازعة العادية خاصة في وجود طرف قوي متمثلا في الادارة وما تتميز به من امتيازات السلطة العامة، فهو يمنح للقاضي الاداري دورا ايجابيا في البحث عن الادلة والضغط على الخصوم لتقديم كل مايراه مناسبا لفض النزاع.

Résumé : L'enquête administrative est un pilier fort du contentieux administratif et une distinction distincte du conflit normal, notamment en présence d'un parti fort représenté dans l'administration et les privilèges de l'autorité publique, elle donne au juge administratif un rôle positif dans la recherche de preuves et la pression sur ses adversaires.

Abstract: The Administrative Investigation is a strong pillar of the administrative dispute and a distinct distinction from the normal dispute, especially in the presence of a strong party represented in the administration and the privileges of the public authority, it gives the administrative judge a positive role in the search for evidence and pressure on the adversaries to provide whatever is appropriate for the resolution of the dispute.
