Abstract

الملخص: وضعت المرافق الاستشفائية لأداء مهمة سامية، وخدمة نبيلة تهدف من ورائها إلى خدمة المجتمع وتحقيق غايتها المنشودة والمتمثلة في التخفيف من معانات المرضى وآلامهم، ولا يتحقق هذا الأخير إلا بوجود أطباء ومساعدين مختصين في الميدان فوجب على هؤلاء احترام أخلاقيات وأصالة مهنتهم، وفي حالة الإخلال بما نص عليه القانون أو القواعد التي تحكم مهنتهم، فهنا تقوم المسؤولية الإدارية للمرافق الاستشفائية فكل شخص تضرر من هذه الأخطاء له الحق في رفع دعوى قضائية التي وجب اقترانها بالإثبات لتأكيد الضرر، ويكون الحكم بجبر هذا الأخير في شكل التعويض.
