Abstract

الدفع بعدم دستورية القوانين إجراء جديد في القانون الجزائري، جاء به التعديل الدستوري لسنة 2016 في المادة 188 منه، حيث سمح المؤسس الدستوري للمتقاضين بالدفع بعدم دستورية نص تشريعي في حال كان ماسا بحقوقهم وحرياتهم التي يضمنها الدستور، وفي تعزيز المواطنة والديموقراطية وتدعيم دولة القانون من جهة، وحماية الحقوق والحريات العامة من جهة أخرى، وعليه فقد تم إصدار القانون العضوي رقم 18-16 المتضمن شروط وكيفيات تطبيق الدفع بعدم الدستورية.
