إمتيازات السلطة العامة في إنهاء العقد الإداري

Abstract

الملخص: تعتبر سلطة الإدارة في إنهاء العقد الإداري من أبرز الخصائص التي يمتاز بها العقد الإداري عن غيره من العقود الأخرى ، وإحدى أخطر السلطات التي تتمتع بها جهة الإدارة في مواجهة المتعاقد معها لما يترتب عنها من وضع حد نهائي وفاصل في تنفيذ العقد الإداري ، والتي تستطيع الإدارة مباشرتها بنفسها دون اللجوء إلى القضاء وذلك إما تحقيقا لمصلحة عامة أو لخطأ جسيم إرتكبه المتعاقد أثناء تنفيذ العقد.. Résumé : L'autorité de l'administration pour résilier un contrat administratif est considérée comme l'une des caractéristiques les plus remarquables qui distinguent ce type de contrat des autres. Il s'agit également d'un des pouvoirs les plus importants dont dispose l'entité administrative pour faire face à la partie contractante, en raison de l'effet final et contraignant qu'il a sur l'exécution du contrat administratif. L'administration a la possibilité d'exercer ce pouvoir de manière autonome, sans recourir à la justice, soit pour atteindre l'intérêt public, soit en cas d'erreur grave commise par la partie contractante lors de l'exécution du contrat.

Abstract The authority of the administration to terminate an administrative contract is considered one of the most prominent features distinguishing it from other types of contracts. It is also one of the most significant powers held by the administrative entity in dealing with the contracting party, due to the final and conclusive effect it has on the implementation of the administrative contract. The administration has the ability to exercise this power on its own, without resorting to the judiciary, either to achieve a public interest or in the case of a serious mistake committed by the contracting party during the execution of the contract.
