Abstract

الملخص: تتمتع الدولة الساحلية وفقا لأحكام اتفاقية 1982 بالسيادة أوبالحقوق السيادية، على المناطق ، هذه السيادة أو الحقوق البحرية التي تشكل مياهها الإقليمية ويمكن للدولة الساحلية من خلال السيادية ممارسة حقوقها السابقة إما بإستعمال أو استغلال الثروات الموجودة في هذه المناطق سواء التي كانت تعلو قاع البحر أو قاعه أو باطن أرضه، وتتقرر للدولة أيضا عن طريق هذه الحقوق حماية وحفظ وتنظيم الثروات في هذه المناطق. في مقابل ذلك، على الدولة الساحلية أن تتحمل واجباتها إتجاه السفن الأجنبية عند مرورها في هذه المناطق البحرية واحترام كذلك سيادات الدول الأخرى وقواعد القانون الدولي.

Résumé Les états côtiers jouissent de l'autorité sur leurs eaux terretoriales et ce, conformément au traité de 1982. Cette souvrainté s'étend au-delà des côtes maritimes jusqu'aux profondeurs marines conformément aux conditions stipulées par le dit traité. Les droits maritimes comprennent les richesses des profondeurs dans ladite zone ainsi que les droits de passage des navires portant les bannières d'autres pays. Chaque état doit obligatoiremnt respecter les régles et dispositions du droit maritimes.

Abstract In accordance with the provisions of the 1982 Convention, the coastal state enjoys sovereignty or sovereign rights over the areas, this sovereignty or marine rights that constitute its territorial waters. the subsoil of his land, and the state also decides through these rights to protect, preserve and organize the wealth in these areas. In return, the coastal state must bear its duties towards foreign ships when passing through these sea areas and respect the sovereignty of other countries and the rules of international law.
