آليات تطبيق القانون الدولي الانساني على الصعيد الدولي

Abstract

ملخص: يعتبر القانون الدولي الإنساني أحد أهم فروع القانون الدولي العام، فهو قانون ينطبق أثناء النزاعات المسلحة، وهدفه الأسمى هو التخفيف من ويلات الحروب وآلامها، عن طريق حماية المقاتلين الذين صاروا عاجزين عن القتال والأشخاص الذين لا يشاركون في القتال أصلا، فضلا عن حماية الأعيان المدنية والممتلكات الثقافية، لكن الوصول إلى تحقيق الغايات تحتاج إلى آليات دولية فعالة تكفل إنفاذ قواعده وهو ما حاول المجتمع الدولي فعله من خلال الآليات الردعية وآليات الإشراف والرقابة.

Résumé: Le droit international humanitaire est l'une des branches les plus importantes du droit international public. C’est le droit applicable en cas de conflit armé et son but ultime est d’atténuer le fléau de la guerre est ses douleurs, en protégeant les combattants qui sont devenus incapables de combattre et les personnes qui participent pas initialement aux combats, ainsi que la protection des biens de caractère civil et les biens à caractère culturels. Cependant pour la réalisation des objectifs ; la communauté internationale a besoin de mécanismes internationaux efficaces pour garantir l’application des règles et c’est ce qu’elle a tenté de faire par des mécanismes dissuasifs, et des mécanismes de surveillance et de contrôleAbstract: The human international law is considered to be one of the general international law branch. This law is applicable during militiry conflicts whose higher objective is to reduce the calamties and sufrings of wars through protecting the fighters who become unable to fight and the people who do not take part in fighting at all. besides protecting the civil anthorities and aultural properties. But the achievement of objectives need efficient international mechanisms to guarantee the application of its laws, this is what the word community has tried to do through preventive mechanisms and super vision and control mechanisms as well.
