منازعات التعويض عن نزع الملكية للمنفعة العامة

Abstract

ملخص يعد إجراء نزع الملكية من أجل المنفعة العامة وسيلة استثنائية في يد الإدارة لاكتساب العقارات عن طريق نزعها من مالكيها من أجل إنجاز المشاريع ذات النفع العام، وهو إجراء يتم في حدود النص القانوني ومقابل تعويض قبلي وعادل لأصحاب العقارات والحقوق العينية. ولكن في حالة عدم رضا المنزوع ملكيته بالتعويض المقدر له من طرف الإدارة له الحق في رفع دعوى التعويض أمام القضاء الإداري خلال الأجل المحدد قانونا، وذلك من أجل تقديم التعويض المستحق للمنزوع ملكيته من طرف القاضي الإداري، وليقوم هذا الأخير بتقدير تعويض عادل ومنصف له كافة الصلاحيات في اللجوء لإجراءات التحقيق والاستعانة بالخبراء لتقدير تعويض عادل ومنصف وتحقيق التوازن بين المصلحة العامة والمصلحة الخاصة.

Résumé La procédure d'expropriation pour cause d'utilité publique est un moyen exceptionnel entre les mains de l'administration pour acquérir des biens immobiliers et des droits immobiliers de ses propriétaires, afin de réaliser des projets d'intérêt public.La satisfaction de l'exproprié de l'indemnité estimée pour lui par le l'administration a le droit de déposer une demande d'indemnisation devant le tribunal administratif dans le délai légal, afin de fournir l'indemnité due à l'exproprié par le juge administratif, et pour ce dernier d'estimer une indemnité juste et équitable, et il a tout le pouvoir de recourir à des procédures d'enquête et de faire appel à des experts pour évaluer une indemnisation juste et équitable et pour trouver un équilibre entre l'intérêt public et l'intérêt privé.

Abstract The procedure of expropriation for the public benefit considered as an exceptional management method aims to acquire real estate by expropriating it from its owners in order to complete projects of public benefit.It is a procedure that takes place within the limits of the legal text with an exchange and fair compensation of the real estate and rights's owners, but in case that the expropriated is not satisfied with the compensation estimated for him by the instrument, he has the right to file a compensation claim before the administrative court within the legally specified period . in order to provide the compensation due to the expropriated by the administrative judge Who estimate a fair and equitable compensation,that has all the powers to resort the investigation procedures and getting help of experts to estimate fair and equitable compensation also to achieve a balance between the public benefit and the private benefit
