Abstract

ملخص: يعد موضوع مضار الجوار غير المألوفة في التشريع الجزائري في غاية الأهمية على المستوى القانوني، نظرا لارتباطه بواقع يومي معاش يتميز بأنواع متميزة ومتعددة من الأضرار التي لها علاقة وطيدة بالجوار بصفة خاصة وبالبيئة بصفة عامة. ونجد أن نظرية مضار الجوار غير المألوفة مستمدة من الشريعة الإسلامية، إلا أنها مرت بمراحل زمنية مختلفة والتي من خلالها واكبت التطور الحاصل، وظهرت في أشكال مختلفة. وقد اعترف المشرع الجزائري بمسؤولية الجار عن الأضرار التي يلحقها بجاره شرط أن تكون خارجة عما هو مألوف، وسلطة تقدير هذه الأضرار تركت للقضاء، وقد تكون هذه الأضرار نتيجة سلوك عادي للجار أو من تعسف في استعمال الحق، والذي جعله المشرع قيدا عاما يترتب على تجاوزه قيام المسؤولية والتي تتمثل في المسؤولية المدنية. وقد اختلف فقهاء القانون حول الأساس الذي تقوم عليه المسؤولية المدنية عن مضار الجوار غير المألوفة وانقسمت آرائهم، إلا أن المشرع الجزائري قد أسس هاته المسؤولية على نظرية التعسف في استعمال الحق، لكن هذا الأساس يعد أساسا ضيقا لذلك وجب على المشرع الجزائري البحث أكثر في هذه المسألة من أجل الوصول إلى تكييف قانوني دقيق وسليم للمسؤولية عن مضار الجوار غير المألوفة.

Résumé: Le sujet des quartiers inconnus dans la législation algérienne est très important au niveau juridique car il est lié à une situation de vie quotidienne caractérisée par différents types de dommages qui entretiennent des relations étroites avec le quartier en particulier et l'environnement en général. La théorie des quartiers inconnus découle de la loi islamique, mais elle a traversé différentes périodes au cours desquelles elle a suivi le développement et est apparue sous différentes formes. Le législateur algérien a reconnu la responsabilité du voisin pour les dommages causés à son voisin, à condition qu'ils soient hors du commun. Responsabilité qui est la responsabilité civile. quartiers inconnus et leurs avis étaient partagés, mais le législateur algérien a fondé cette responsabilité sur la théorie de l'abus de droit. Afin de parvenir à une adaptation juridique précise et appropriée de la responsabilité pour les dommages de voisinage inconnus.
