تنظيم حالة شغور منصب رئيس الجمهورية في ضوء الدستور الجزائري

Abstract

يعالج هذا البحث الحالات المؤدية إلى شغور منصب رئيس الجمهورية في المادة 102 من التعديل الدستوري 2016م، والأوضاع الدستورية التي تحكم تنظيم هذا الشغور الرئاسي، انطلاقا من أهمية منصب الرئاسة، ودوره في النظام الدستوري الجزائري، مع الإحاطة بالقواعد الموضوعية الإجرائية التي تحكم رئيس الدولة بالنيابة، والآثار المترتبة عن الشغور حتى تنظيم انتخابات رئاسية واستلام المهام وأداء اليمين الدستوري. Résumé : Cette recherche porte sur les cas qui ont conduit à la vacance du président de la République à l’article 102 de l’amendement constitutionnel 2016, et les conditions constitutionnelles régissant l’organisation de cette vacance présidentielle, en fonction de l’importance de la présidence et de son rôle dans le système constitutionnel algérien, en tenant compte des règles de procédure de fond régissant le chef de l’Etat par intérim, et des implications de la vacance jusqu’aux élections présidentielles, de la réception des fonctions et de l’exécution du serment constitutionnel. Abstract: This research addresses the cases leading to the vacancy of the president of the Republic in article 102 of the Constitutional Amendment 2016, and the constitutional conditions governing the organization of this presidential vacancy, based on the importance of the presidency and its role in the Algerian constitutional system, taking into account the substantive procedural rules governing the acting Head of State, and the implications of vacancy until presidential elections, the receipt of functions and the performance of the constitutional oath.
