وسائل الاتصال الحديثة وحجيتها في الإثبات

Abstract

الملخص تناولت الدراسة مدى حجية وسائل الاتصال الحديثة في الإثبات من منظور التشريع الجزائري، حيث ظهرت أهمية الدراسة في أن الوسائل التقليدية في الإثبات قد لا تتلاءم مع التطور العلمي والتكنولوجي الهائل، وحتى يتحقق عنصر الأمن والطمأنينة بين أفراد المجتمع عند إثبات حقهم أمام القاضي كان لابد من وسائل علمية حديثة تتفق مع هذا التطور، حيث هدفت الدراسة إلى معرفة مفهوم وسائل الاتصال المستحدثة وأهمتها وأنواعها ومدى كفاءتها في الإثبات.

Résume :

L'étude a porté sur l'étendue de l'authenticité des moyens de communication modernes en matière de preuve du point de vue de la législation algérienne, où l'importance de l'étude est apparue dans la mesure où les moyens de preuve traditionnels peuvent ne pas être compatibles avec le formidable développement scientifique et technologique, et jusqu'à ce que l'élément de sécurité et de tranquillité soit atteint entre les membres de la société lors de la preuve de leur droit devant le juge, il était nécessaire d'utiliser les moyens de preuve .La science moderne est d'accord avec cette évolution, car l'étude visait à connaître le concept des nouveaux moyens de communication, leur importance, leurs types et leur efficacité dans la preuve.

Abstract :

The study dealt with the extent of the authenticity of modern means of communication in proof from the perspective of Algerian legislation, where the importance of the study appeared in that the traditional means of proof may not be compatible with the tremendous scientific and technological development, and until the element of security and tranquility is achieved among members of society when proving their right before the judge, it was necessary to use the means of proof. Modern science agrees with this development, as the study aimed to know the concept of the new means of communication, their importance, types, and their efficiency in proof.
