420 الحماية القانونية للمرأة في قانون الأسرة الجزائري

Abstract

الملخص: لقد ضمن المشرع الجزائري للمرأة المتزوجة العديد من الحقوق، منها حقها في إبرام عقد زواجها بنفسها، وحقها في الصداق واستقلالية ذمتها المالية، وحقها في المعاشرة بالمعروف، وحقها في النفقة والميراث، وغيرها من الحقوق المستمدة من الشريعة الإسلامية، لكن مع ذلك لا يزال قانون الأسرة متهما بهضم حقوق المرأة المتزوجة. Résumé : Le législateur a préserver de nombreux droits a la femme mariée, son droit a conclure son contrat de mariage, son droit a la dot, sa liberté financière, sa cohabitation, son droit a la pension et a l’héritage, et d’autres droits issus de la charia Musulmane, toutefois, le code de la famille est toujours accuse d’avoire prive la femme mariée de ses droits. Abstract: The legislature has preserved so many rights to married women, the right to conclude a marriage contract, the right to the don cry, the right to financial freedom, cohabitation, the right to the pension and the legacy, other right taken from the Muslim Sharia, however, the family code remains a cause of depriving married women of their rights.
