Abstract

الملخص: أن الهدف الأساسي من صدور اتفاقية فيينا للعلاقات الدبلوماسية لعام 1961 هو رغبة الدول في تأسيس التمثيل الدبلوماسي وفق مبادئ القانون الدولي من أجل حماية مصالحها ومصالح رعاياها وإقامة علاقة دبلوماسية في مختلف المجالات ، ولهذا تسهر البعثة الدبلوماسية التي تمثل الجهاز الحكومي بإقليم دولة أخرى وحماية مصالحها، كما هي وسيلة تستخدمها الدولة لإقامة وإدانة العلاقات الدبلوماسية فيما بينها على أساس الرضا المتبادل ، لذا تعد المرجعية الأهم في تبليان الحقوق و الواجبات الخاصة بأفراد البعثات الدبلوماسية كما تساهم في تنمية العلاقات الودية بين الدول بغض النظر على اختلاف نظمها الدستورية والاجتماعية.. Résumé L’objectif primordial de l’adoption de la Convention de Vienne sur les Relations Diplomatiques de 1961, est l’établissement des représentations diplomatiques conforme aux principes du Droit international afin de protéger leurs intérêts et pour l'immunité du personnel diplomatique et l'inviolabilité des ambassades mais aussi, pour la fondation de relations diplomatiques dans divers domaines. A cet effet, la mission de la représentation diplomatique d’un Etat donné, comme moyen de l’établissement des relations diplomatiques sur la base du consentement mutuel, veille à la protection de leurs intérêts. Conséquemment, elle est la plus importante référence de clarification des droits et des devoirs spécifiques des membres des missions diplomatiques. Outre, elle contribue au développement des relations amicales entre les Etats peu importe leur système constitutionnel et social respectif. Summary The primary objective of the adoption of the Vienna Convention on diplomatic relations of 1961 is the establishment of diplomatic representations in accordance with the principles of international law in order to protect their interests and for immunity of diplomatic personnel and the inviolability of embassies but also, for the founding of diplomatic relations in various fields. To this end, the mission of the diplomatic representation of a given State, as a means of establishing diplomatic relations on the basis of mutual consent, ensures the protection of their interests. Consequently, it is the most important reference for clarifying the specific rights and duties of members of diplomatic missions. In addition, it contributes to the development of friendly relations between States regardless of their respective constitutional and social systems
