حماية الأموال والممتلكات في النزاعات الدولية في ظل القانون الدولي الإنساني

Abstract

ملخص: مع كثرت الحروب التي تقوم بها الدول و فشل المجتمع الدولي في منع وقوعها اتجهت جهوده إلى تنظیم هذه الحرب و جعلها أكثر إنسانیة فأبرمت اتفاقیات دولیة في هذا الشأن تستهدف تنظیم الح رب من حیث الأسلحة المستخدمة فیها و من حیث طرق وأسالیب إدارتها وكذلك حمایة من لا یشارك فیها . أما قواعد الحمایة فقد اشتملت على حمایة الأموال و الممتلکات و حمایة خاصة ببعض الفئات من الأموال والممتلکات و المتمثلة في المنشآت الصحیة، الأعیان التي لا غنى عنها لبقاء السکان ، الممتلکات الثقافیة. وقد تضمنت الإتفاقیات الدولیة بعض القواعد والضمانات، و لعل أبرز ضمانة هي تجریم الاعتداءات على الأموال والممتلکات و إمکانیة متابعة المجرمین أمام المحکمة الجنائیة الدولیة المنشأة خصیصا لمحاكمة مجرمي الحرب.
