دور المحكمة الدستورية في حماية الحقوق والحريات الأساسية في ظل التعديل الدستوري 2020

Abstract

الملخّص: تكريسا لمبدأ سمو الدستور، وتعزيز مكانة الحقوق والحريات الأساسية، استحدث المؤسس الدستوري في التعديل الدستوري 2020 هيئة مستقلة تحت مسمى المحكمة الدستورية، ذات طبيعة قضائية بدلاً من المجلس الدستوري ذو الطبيعة السياسية، مكلفة باحترام الدستور، أسند إليها صلاحيات تمكنها من الحفاظ على استقرار سير نشاط المؤسسات و ضمان احترام الحقوق والحريات الأساسية. نظراً للأهمية البالغة التي يكتسبها موضوع الحقوق والحريات الأساسية فإنه لا بد من وجود آليات ووسائل فعالة لحمايتها، إذ تعتبر الرقابة على دستورية القوانين من أبرز الدعائم الفنية لها، حيث تهدف إلى منع صدور أي نص سواء كان تشريعاً أو تنظيمياً مخالف للدستور، شكل هذا الهاجس لحماية الحقوق والحريات الأساسية صلب أي تشريع أو اعتداء، كما عمل المؤسس الدستوري إلى تبني آلية الدفع بعدم الدستورية التي تمكن الأفراد من الدفع بعدم دستورية القوانين الماسّة بحقوقهم وحرياتهم الأساسية التي كفلها لهم الدستور. Abstract In affirming the principle of constitutional supremacy and enhancing the status of rights and freedoms, the constitutional founder established, in the 2020 constitutional amendment, an independent body named the Constitutional Court, of a judicial nature, replacing the politically-oriented Constitutional Council. This Court is entrusted with upholding the Constitution and vested with powers enabling it to maintain the stability of institutional operations and ensure respect for rights and freedoms. Given the critical importance of fundamental rights and freedoms, effective mechanisms and tools for their protection are essential. Judicial review of the constitutionality of laws is a key technical pillar in this regard, aiming to prevent the enactment of any legislative or regulatory text that contravenes the Constitution. This concern for safeguarding fundamental rights and freedoms lies at the core of any legislation or violation. The constitutional founder also adopted the mechanism of the exception of unconstitutionality, allowing individuals to challenge the constitutionality of laws infringing upon their constitutionally guaranteed rights and freedoms. Résumé : Réforme constitutionnelle de 2020, une instance indépendante dénommée la Cour constitutionnelle, de nature judiciaire, en remplacement du Conseil constitutionnel de nature politique. Cette Cour est chargée du respect de la Constitution et se voit attribuer des prérogatives lui permettant de garantir la stabilité du fonctionnement des institutions ainsi que le respect des droits et libertés. Compte tenu de l’importance capitale du sujet des droits et libertés fondamentales, il est indispensable de mettre en place des mécanismes efficaces pour leur protection. Le contrôle de la constitutionnalité des lois constitue l’un des piliers techniques majeurs à cet égard, visant à empêcher l’adoption de tout texte, qu’il soit législatif ou réglementaire, contraire à la Constitution. Ce souci de protection des droits et libertés fondamentaux est au cœur de toute législation ou atteinte. Le constituant a également adopté la procédure de l’exception d’inconstitutionnalité, permettant aux individus d’invoquer l’inconstitutionnalité des lois portant atteinte à leurs droits et libertés garantis par la Constitution.
