نظام الشهر العقاري في التشريع الجزائري

Abstract

الملخص: هذا البحث عبارة عن دراسة موضوع الشهر العقاري في التشريع الجزائري، بهدف معرفة إلى أي مدى يحمي الشهر العقاري الملكية العقارية و تأمين و حسن سير إستقرار المعاملات العقارية. بعد التعمق في الموضوع و دراسته توصلنا إلى أن المشرع الجزائري تأثر بنظام الشهر العيني و يسعى إلى تعميمه في كامل التراب الوطني عن طريق المسح العام للأراضي، و يمكن الجزم بأن المشرع الجزائري أحسن الفعل باختياره للشهر العيني على حساب نظام الشهر الشخصي كونه لا يحقق الهدف الرئيسي الذي جاء من أجل نظام الشهر العقاري، إضافة إلى ما يشوبه من عيوب. Résumé : Cette recherche est une étude du sujet de l’enregistrement immobilier dans l » législation algérienne, dans le but de savoi dans quelle mesure l’enregistrement immobilier protège la propriété immobilière et assure le bon fon t »onne’ent et la stabilité des transactions immob l »ères’ Après avoir approfondi et étudié le sujet, n u » avons conclu que le législateur algérien s’est laissé influencer par le système publicité réelle et cherche à le diffuser sur l’ensemble du territoire national à travers un cadastre général. On peut affirmer que le législateur algérien a bien fait en choisissant la publicité réelle au détriment de la publicité personnelle, car il n'a’teint pas l’objectif principal du système d'enregistrement immobilier, en plus de ses défauts Summary : The extract of this is a study in the Algerian legislation for the aim of knowing to what extent could the real estate protects the estate properties, deposit, good management and the stability of landed deals However, this research has studied, it has been concluded that the Algerian legislation has affected by the real estate publicity system and it aims to populaize it throughout the national territory through a general land survey, and it can be asserted that the Algerian legislation did the right thing by choosing the real estate publicity at the expense of personal real estate system as it achieves the principle goal that comes for it the real estate and all it’s de fects as well.
