قواعد الضبط البيئي المطبّقة على المنشآت المصنفة الصناعية

Abstract

ذهب المشرع الجزائري بوضع قواعد ضبط بيئي طبقت على المنشآت المصنفة وذلك طبقا للمرسوم التنفيذي رقم 06/198المؤرخ في 31ماي 2006 الذي يضبط التنظيم المطبق على المؤسسات المصنفة لحماية البيئة أثناء طلب الترخيص لإنشاء مؤسسة مصنفة حيث اقتصر عمل ادارة البيئة على اجراءات أولية واجراءات نهائية من أجل منح الترخيص للمستغل لإنشاء منشأة مصنفة سواء كانت آليات ادارية أو آليات تقنية وذلك لتفادي خطر التلوث الصناعي على المجتمع أو على البيئة بصفة عامة RESUME Le législateur algérien a ensuite établi des règles de contrôle de l’environnement applicables aux entreprises classées, conformément au décret exécutif n°06/198 du 31 mai 2006 réglementant la réglementation applicable aux institutions classées pour la protection de l’environnement lors de la demande de licence d’établissement d’une entreprise classée. Lorsque les travaux du ministère de l’environnement se limitaient à des procédures préliminaires et des procédures définitives permettant à l’utilisateur de créer un établissement classifié, qu’il s’agisse de de mécanismes administratifs ou techniques permettant d’éviter le risque de pollution industrielle pour la société ou l’environnement en général. ABSTRACT The Algeria legislator went on to establish environmental control rules applied to classified enterprises, in accordance with executive decree n°06/198 of 31 may 2006,which regulate the regulation applicable to the classified institutions for the protection of the environment during the application for licensing the establishment of a classified enterprise where the work of the department of environment was limited to preliminary procedures and final procedures in order to grant the license to the user to establish a classified facility, whether administrative or technical me charismas in order to avoid the risk of industrial pollution to society or the environment in general.
