دور محكمة العدل الدولية في تطبيق قواعد القانون الدولي الانساني

Abstract

ملخص: محكمة العدل الدولية بوصفها الجهاز القضائي للأمم المتحدة في تطبيق القانون الدولي طبقا لما ورد في المادة 38 من نظامها الأساسي،فان دورها برز بشكل أكبر في المجال القضائي والإفتائي لتعرضها لجوانب مختلفة وقضايا تتعلق بالقواعد القانونية الدولية الخاصة بالقانون الدولي الإنساني وسمو قواعد هذا القانون في أحكام معترف بها من طرف المحكمة واهتمامها بالقانون الدولي لحقوق الإنسان عن طريق تكريس مبادئه العالمية،مما ساعد على تفعيل دور ها وبعث الروح فيها وزيادة نشاطها في تطبيق عدالة القانون الدولي الإنساني وصون السلم والأمن العالميين .

Résumé : La Cour internationale de justice, en tant qu’organe judiciaire des nations Unies dans l’application du droit international conformément à l’article 38 de son statut, a joué un rôle plus important dans les domaines juridiques et occultes des normes juridiques internationales du droit international humanitaire et des normes de ce droit.par la Cour et son intérêt pour le droit international des droit de l’homme par la consécration de ses principes universels qui ont contribué à activer son rôle et respirer l’esprit et accroitre ses activités dans l’intérêt de la justice du droit international humanitaire et du maintien de la paix et de la sécurité. Summary : The international Court of justice as the judicial organ for the united nations in the application of the international law ,according to the article 38 of the statute of the court.Its role has become more prominent in the judicial field and infallibility, because it has faced different aspects and cases related to the rules of international law sepecial to international humanitarian law and the rules of this law in the recognized provision by the court’s interests for the international human rights and devoting universal principles, too .This has helped her to activate her role and spirit, also increasing the activity in the application of the justice of humanitarian law and the maintenance of both international peace and security.
