ميراث المرأة في قانون الأسرة الجزائري

Abstract

ملّخص تناول هذا البحث مسألة ميراث المرأة في قانون الأسرة الجزائري، حيث تمّ التطرّق في البداية إلى الأحكام المتعلّقة بتوريث المرأة وذلك ببيان أركان، أسباب، شروط، وموانع ميراثها، وصولاً إلى الحالات التي ترث فيها وهي إما بالفرض، وإما عصبة بالغير، أو عصبة مع الغير. ولقد إستمد قانون الأسرة الجزائري جلّ أحكامه في توريث المرأة من أحكام الفقه الإسلامي. Résumé : Cette recherche a porté sur la question de l’héritage des femmes dans le droit de la famille algérien en ou les dispositions relatives à l’héritage des femmes ont été initialement abordées en esqliquant les piliers, les raisons, les conditions et les obstades a leur héritage. En arrivant aux cas dans lesquels elle mérite son héeitage quelle que soit sa condition. Le code famille algérien tire la plupart de ses dispositions de la jurisprudence islamique. The provisions relating to inhertance of women were initialy addressed by stating the reasons conditions and barriers of into in heritance. To the cases in which she inherits whatever her condition. The algerian familly law derives its provisions its provisions in inheritance of women from the provisions of Islamic jurisprudence.
