الآثار القانونية لإجراءات الحجر الصحي على الحقوق والحريات العامة

Abstract

الملخص: تهدف هذه الدراسة إلى توضيح أثر الضبط الإداري في حماية الصحة العامة، من أي خطر أو مرض معدي، و هو الحل بالنسبة لجائحة كورونا كوفيد19، و التي تصدت لها الجزائر باستعمال وسائل الضبط الإداري، و المتمثلة في فرض إجراءات الحجر الصحي، على المستوى الوطني، لكن هذه الإجراءات مست بالحقوق و الحريات العامة الخاصة بالأفراد، خلال مدة سريانها، و بالأخص حق التنقل، حق العمل، حق التجمع و الاجتماع، حيث يستمد هذا المساس مشروعيته من استثنائية الوضع الصحي، و الذي يهدف إلى حماية أسمى الحقوق، و هو حماية حق الحياة و حق الصحة. Résumé : Cette étude vise a préciser l’impact du contrôle administratif dans la protection de la santé publique contre tout danger, ou maladie contagieuses, ainsi que le cas de la pandémie de corona, à laquelle d’Algérie a été confrontée en utilisant une méthode de contrôle représentée par l’imposition des procédures de confinement sanitaire au niveau national, mais ces mesures ont porté atteinte aux droits et libertés publics pendant leur durée de validité, notamment le droit à mobilité, le droit au travail et le droit de réunions, ou ce préjudice tire sa légitimité de la situation sanitaire exceptionnelle, qui vise à protéger les droits et libertés représentées dans la protection du droit à la vie et du droit à la santé. Abstract : This study aims to clarify the impact of administratif control in protecting public health from any danger or contagious disease, as well as the case with the corona pandemic , which algeria cofronted by using a control method reprsented in imposing quarantine procedures at the national level, but these measures affected public freedoms and rights during their period of validity, especially the right of mobility, the right to work and the right to assembly, where this prejudice dervves its legitimacy from exceptional health situation, which aims to protect the highest rights and freedoms represented in the protection of the right to life and the right to health.
